It depends.  If you are speaking of a top-down view then it would
be "tergiant", which is an unusual position to find a bird in heraldry.
If you are thinking of a side-on view as if the bird were flying naturally,
then it would technically be "volant".  HOWEVER, the position
you describe is in "trian" or 3-d aspect, which is not a generally
acceptable position to draw a heraldic charge--especially
animals.

Caveat:  if a bird actually were flying with one wing up
and one down, it would be spinning out of control..... 8^)

My suggestion: go for "displayed tergiant", AND draw it
that way.  If you draw it in trian aspect, it will very probably
be returned.  In any case, what has been described is a
"weird" position, and less likely to be acceptable.

Even better would be to submit it "volant" and stick to
the standard heraldic way of drawing it.
